These Terms and Conditions of Sale apply only to the purchase of merchandise from our online store. They are separate from, and do not replace, our Paduka Seva Terms and Conditions and our Privacy Notice.
- About us and these terms
These terms apply when you buy merchandise from Shree Vitthal-Rukmini Temple UK (“we”, “us”, “our”, “the Charity”), a charity registered in England and Wales under charity number 1214057. Please read these terms carefully before placing an order. By placing an order you confirm that you accept these terms. If you do not agree to them, please do not place an order. Nothing in these terms affects your legal rights as a consumer.
- The products
Our products include traditional devotional wear (such as kurtas, jackets, phetas, topis and shelas), devotional books and prayer items. Product images and colours are for illustration only, and the item you receive may vary slightly. Many items are traditionally made, so small variations in colour, weave, finish and measurement are normal and are not defects.
Clothing sizes are shown on each product. Please check the size guidance before ordering, as some items are available in limited sizes and stock.
- How your order is placed and accepted
Our store is operated through our online checkout provider, Ticket Tailor. When you place an order, you are making an offer to buy the product. Your order is accepted, and a contract is formed between you and the Charity, only when we send you an order confirmation. If we cannot accept your order (for example, because an item is out of stock or there has been a pricing error), we will let you know and will not charge you, or will refund any payment already taken.
- Price, fees and VAT
4.1 Prices are shown in pounds sterling (GBP) and are the prices in force at the time you place your order.
4.2 A per-item booking fee is applied by our checkout provider and is shown separately at checkout. The total amount payable, including the booking fee and any delivery charge, is displayed before you confirm and pay for your order.
4.3 Prices are inclusive of any VAT that applies. [ Trustees to confirm the Charity’s VAT position: if the Charity is not registered for VAT, state that no VAT is charged; if it is registered, insert the VAT registration number. ]
4.4 We take care to ensure prices are correct. If we discover an error in the price of goods you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel the order.
- Payment
Payment is taken at the time you place your order, through our checkout provider and its secure payment processor. We do not receive or store your full card details. Please see our Privacy Notice for how your information is handled.
- Delivery and collection
6.1 We fulfil orders by [ postal delivery within the United Kingdom / collection at our temple events / both – select and complete ]. Available options, any delivery charges and estimated timescales are shown at checkout or are as follows: [ insert delivery methods, costs and timescales ].
6.2 We will deliver your order without undue delay and, in any event, within 30 days of the date of our order confirmation, unless we agree a different time with you.
6.3 Responsibility for the goods, and the risk of loss or damage, passes to you when the goods are delivered to the address you gave us, or when you (or a person you nominate) collect them.
6.4 If no one is available to take delivery, the carrier may leave a card explaining how to rearrange delivery or collect the goods.
6.5 If delivery is delayed by an event outside our control, we will contact you as soon as possible and take steps to reduce the delay.
- Your right to change your mind (statutory right to cancel)
Because you are buying online, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel your order and return the goods for a refund, as set out below. This is in addition to your other legal rights.
7.1 You have 14 days, starting the day after you (or someone you nominate) receive the goods, to tell us that you wish to cancel. Where your order is delivered in several instalments, the period runs from the day you receive the last item.
7.2 To cancel, please tell us clearly by email at temple@vitthalrukmini.org.uk, quoting your order reference. You may use the model cancellation wording at the end of these terms, but you do not have to.
7.3 After telling us you wish to cancel, please return the goods to us without undue delay and within 14 days. The return address is: [ insert returns address ].
7.4 You are responsible for the cost of returning the goods, unless the goods are faulty or not as described. We recommend using a tracked or proof-of-postage service, as you are responsible for the goods until they reach us.
7.5 You may examine the goods as you would in a shop, but please do not wear, wash or use them beyond what is necessary to check them, and please keep any tags attached. We may reduce your refund to reflect any loss in the value of the goods caused by handling beyond what was necessary.
7.6 We will refund the price you paid for the goods, together with the standard delivery cost (if any) and, where the statutory right to cancel applies, the booking fee. We may withhold the refund until we receive the goods back or you provide evidence that you have returned them. We will make the refund within 14 days using the same payment method you used to order.
7.7 The statutory right to cancel does not apply to goods that are made to your specification or personalised, or to sealed goods that are not suitable for return for health or hygiene reasons once unsealed. Most of our products do not fall into these categories, and where an exception applies we will make this clear before you order.
- Faulty, damaged or misdescribed goods
Your legal rights under the Consumer Rights Act 2015 are not affected by these terms. Goods we supply must be of satisfactory quality, fit for purpose and as described.
8.1 If goods are faulty, damaged on arrival or not as described, please contact us at temple@vitthalrukmini.org.uk with your order reference and, if possible, a photograph.
8.2 If you tell us within 30 days of receiving the goods, you are normally entitled to reject them and receive a full refund. After 30 days, you may be entitled to a repair or replacement and, in some cases, a refund.
8.3 We will cover the reasonable cost of returning faulty or misdescribed goods.
- Cancellation or refusal by us
We may cancel an order and issue a full refund if the goods are unavailable, if there has been a genuine pricing or description error, or if we reasonably believe the order does not comply with these terms. We will always contact you if this happens.
- Intellectual property
The “Mauli” logo, our name, our product images and the content of our devotional books are owned by or licensed to the Charity. You may not copy, reproduce or use them for commercial purposes without our written permission. The products are sold for personal and devotional use, not for resale.
- Our responsibility to you
11.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
11.2 We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, or for any breach of your legal rights in relation to the products.
11.3 As the products are supplied for private and devotional use, we are not liable for any business loss.
- Events outside our control
We are not responsible for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control. If such an event occurs, we will contact you as soon as possible and take reasonable steps to minimise the effect. Where the delay is substantial, you may contact us to cancel your order and receive a refund for any goods not yet delivered.
- Complaints and disputes
We hope you will be happy with your purchase. If something has gone wrong, please contact us first at temple@vitthalrukmini.org.uk so we can try to put it right. If we cannot resolve your complaint, you may seek free independent advice from Citizens Advice (www.citizensadvice.org.uk) or your local Trading Standards service.
- Data protection
We handle your personal information in accordance with our Privacy Notice, which explains what we collect, how we use it and your rights. Please read it alongside these terms.
- Governing law and jurisdiction
These terms are governed by the law of England and Wales. If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live. Nothing in these terms limits the statutory rights available to you as a consumer.
